On the Subject of Revisiting R.I.C.O.

     This episode delves deeper into the Racketeering Influenced and Corrupt Organizations Act (R.I.C.O.), specifically as it pertains to feedback I have received.  Specifically, I was sent a link to another website that presented the idea that R.I.C.O. represented solely an action for bringing claims against organized crime syndicates, which is a dangerous misrepresentation of both the history and the authority of R.I.C.O.  Though R.I.C.O. stems from an effort of the federal government to reign in organized crime, the final legislation was deliberately written to expand beyond simply crime families to all areas of American society where racketeering-style efforts were being used to profit from otherwise lawful enterprises.  To read the full article to which I am responding in this video, please visit: https://www.popehat.com/2016/06/14/lawsplainer-its-not-rico-dammit/

On the Subject of Immunity

    This episode discusses the definitions of government immunity, in specific, absolute and qualified immunity, and how the terms are misused to shield corrupt officials in Montana from consequences of their malfeasance.  When officials can use the term “immunity” to shield themselves from any consequences by claiming they are immune from any prosecution, they become literally untouchable, above the law.  However, the terms do not represent actual irrevocable invulnerability  – in fact, they only protect officials acting without malice or corruption, and their immunity can and should be revoked when they participate in corrupt affairs or abuse their positions to shelter other corrupt actors.

On the Subject of R.I.C.O.

    This episode discusses the broad power of federal government oversight of state issues through the 1970 Racketeering Influenced and Corrupt Organizations Act (R.I.C.O.).  Under R.I.C.O., the federal government has the power to prosecute any enterprise that violates a host of federal and state laws and this includes corrupt government agencies and officials – the only thing needed is a demonstration of at least two acts of criminal conduct over ten years.  To demonstrate the power of this law, I provide a brief history of Operation Court Broom, where federal agents investigated and prosecuted five state judges in Florida in 1992.  This episode is less about what is broken in Montana and more about what could potentially be done to fix it – with a motivated and invested federal authority prosecuting and adjudicating the corrupt system operating in Montana.

On the Subject of Federal Court Censorship In Montana

    This episode demonstrates how Montana uses the federal court system operating in Montana, operated by individuals elevated from within the preexisting corrupt state, to shelter Montana and the elite within its borders from consequences of the Great Montana Conspiracy.  When agents of Montana are operating the courts for the express purpose of censoring claims made against the state of Montana, there can never be justice – especially when the federal courts are setting aside even the pretense of protection of civil liberties for the poor, indigent and disenfranchised populace of the state.

On the Subject of Grand Jury vs. Information

    This episode delves into the twisted method used by Montana to arrest and detain its citizens by completely bypassing any genuine consideration of probable cause.  Where the United States Constitution requires individuals accused of felonies to be indicted by a grand jury of a minimum of twelve common citizens, Montana refuses to abide by federal civil rights by only requiring a prosecutor and judge to agree to have someone arrested.  In other words, a police state where one can be arrested by corrupt government purely on a whim or in pursuit of a political agenda.

    This episode delves into the power wielded by a government that has no moral, ethical nor legal requirement to be honest, and the consequences that stem from the use of propaganda.  My own personal experiences provide the backdrop for this episode and the real world harm caused by misinformation wielded by authorities who have no interest in truth and are motivated instead by their own malignant purpose.  When a government, most espcially one staffed by corrupt officials, has no consequence for deliberate dishonesty, there can be no justice nor democracy.
