On the Subject of Halloween

    This episode takes a break from the serious corruption plaguing Montana and the country to discuss the holiday that is upon us this weekend, Halloween.  Stemming from the Celtic tradition known as Salmain (pronounced Sow-In), Halloween is possibly the single-most celebrated holiday in the United States, with people from all faiths and persuasions celebrating the day in one form or another.  Yet in spite of this, the United States government has still not adopted it as an official holiday.

On the Subject of Manifest Disregard of Law

This episode discusses the practice of judicial officers who use their positions to disregard law and precedent to establish their own personalized forms of “order” – which is a horrifically common practice in Montana.  Worse, it is endorsed and supported by the Montana Supreme Court who covers up the vast majority of rogue judges by upholding their flagrantly unlawful rulings by utilizing the practice of noncitable opinions.  To provide context, I set forth both my own personal experiences with judges who disregard the law to continue to deprive me of civil rights and human dignity, as well as some of what my producer, Bill Russell has endured in Flathead County, Montana.

On the Subject of Ghostwriting Judicial Orders

This episode delves into the unsavery practice of judges having prevailing parties, more than not prosecutors, write their decisions, opinions and orders, in effect having prosecutors being the real people writing judicial precedent.  This practice, though frowned upon by the United States Supreme Court and admonished by appellate courts and state bar associations across the country, remains a legitimate and lawful practice – based upon the pretense that though these judicial opinions passed to others to write still contain at least a true assessment of court proceedings.  However, as is typically the case, Montana takes a questionable practice and makes it a status quo for simply letting judges avoid doing their actual jobs and letting prosecutors actually be the ones to control precedent and the overreaching, prejudicial orders enforced in the state.

On the Subject of Qualified Immunity

This episode discusses two decisions passed down by the United States Supreme Court on October 18, 2021, relating to upholding qualified immunity claims against officers who used ecessive force in the line of duty.  Each of the cases discussed stem from 2016, but they have been adjudicated in the post-2020 and post-Black Lives Matter movements, where excessive force was not only on worldwide display in the death of George Floyd, but also in the rampant abuse against protesters nationwide, making it questionable that when these more recent issues make it to this country’s High Court, whether they will shield even the most monstrous acts of brutality, simply by virtue of the individuals perpetuating these atrocities are law enforcement agents?  Worse, how can the same issues ongoing in Montana ever hope to be resolved if the national model is so far askew?

On the Subject of Promotion of Crime By Government

    This episode discusses the use of Confidential Informants (CIs) and their long, largely unrestrained use as tools by police and authorities.  Though in priniciple, using an embedded informant within the ranks of organized crime or willing to turn over evidence about actual criminal behavior, in Montana, the practice is used to provide blanket license to these CIs to continue in their own criminal enterprises while aiding authorities in arressting larger numbers of people, many of which are often not criminals at all, just set up by the CIs.  Once again, feeding into the prison for profit network, oftentikmes, CIs don’t actually exist but are fabrictaed by authorities to obtain warrants whereby they can try to keep beds in their local jails and prisons full.

On the Subject of Wrongful Convictions

   This episode delves into one of the many consequences of an unrestrained corrupt government: the wrongly convicted.  When motivated by the financial gain of free federal moneys, there are far too many that fall to the hunt to find bodies to fill prison and jail beds in order to cash in on the massive prison for profit system.  To illustrate the point, I discuss the fate of Cameron Todd Willingham, an innocent man convicted and executed for murdering his own children, who died tragically in a home fire.  Though posthumous evidence has proven his innocence, he remains convicted in the annals of history, proving the irreconcilable harm caused by the zealous desire to manufacture crimes rather than investigate real ones.

On the Subject of the State Bar of Montana

    This episode discusses the “intigrated” agency known as the State Bar of Montana and how its structure, existing at the direction of the Montana Supreme Court yet not beng an actual agency of the government, uniquely gives the SBM a position to control a full one third of the state government while sheltering itself and its members from legislative oversight.

On the Subject of Interlocutory Orders

    This episode discusses interlocutory orders, or intermediary orders, and how they are used by the corrupt officials in Montana to essentially deny fair jurisprudence and hearings to citizens either deemed unfavorable or to benefit those in power.  Though interlocutory orders serve a genuine purpose in normal, lawful courts across the country by preventing every small decision prior to a final judgment from bogging down appellate courts, in Montana’s case, they are used to shield lower courts from appeals and to render actions they simply do not want heard into moot status.

On the Subject of the First Attempt To Return Me To Prison

    This episode goes back to my own story for a bit to cover the background surrounding a topic I have often referenced: the circumstances surrounding the first revocation attempt against me.  Released from prison into an unlawful community-based custody for barely two months, the powers-that-be in Kalispell were already aiming at returning me back to prison, using probationary custody that I was never sentenced to serve to harass, provoke and railroad me back to where I could not speak out against them.  Though the effort ultimately failed, it led to the ever-more-oppressive conditions that I am presently detained under.
