On the Subject of Discretion

This episode discusses foundational element of permissible abuse and criminal misconduct in government, discretion.  Both a primary underpinning of both qualified and absolute immunity, discretion is the abilty of government officials to choose to act or not to act within the scope of their duties.  In an age where courts have far too frequently granted immunity to officials based on their discretionary powers without any effort to actually decide if the discretion was justified, it has also become the greatest tool for corrupt officials to pander their own brand of injustice by hiding behind the immunity shield for their misconduct.  If an official can act criminally without consequence, yet justify it as a discretionary act permissible by his or her office, is it any wonder that the Great Montana Conspiracy is so insidious?
